These terms apply to your use of the aussiely.com.au website and JoeyDrive ("app") published by Aussiely Pty Ltd ("Aussiely", "we", "us"). JoeyDrive enables driving instructors to manage their schedule and students, and learners to book driving lessons. Unless we have signed a separate written agreement with you, these terms govern your use. By using our website or app, you agree to these terms. Your use of personal information is also governed by our Privacy Policy
Eligibility
Learners must hold, or be in the process of obtaining, a valid learner driver permit for their state or territory to use the booking features of the app. Instructors must hold all required licences and accreditations for their state or territory. Users must be at least 16 years of age. By using the service, you confirm you meet these requirements.
Using our website and app
You may use our website and app for lawful purposes only. You must not attempt to disrupt them, reverse-engineer them, circumvent security measures, or use them in a way that infringes the rights of any other person.
Intellectual property
The content, design, code, and marks associated with our website and app are owned by Aussiely or used with permission. You may view and share website content for personal, non-commercial purposes with attribution. You may not copy, redistribute, or create derivative works from our app without our prior written consent.
App licence
Subject to these terms, Aussiely grants you a limited, non-exclusive, non-transferable, revocable licence to use the app on devices you own or control, solely for your personal use in booking or managing driving lessons. This licence does not include any right to sublicense, sell, or transfer the app.
Apple App Store apps
If you download JoeyDrive from the Apple App Store, the following additional terms apply:
(a) The licence is limited to use on Apple-branded devices you own or control, as permitted by the Usage Rules in Apple's Media Services Terms and Conditions.
(b) Aussiely, not Apple, is solely responsible for the app and its content.
(c) Apple has no obligation to provide maintenance, technical support, or warranty services for the app. Direct all support requests to Aussiely:
(d) If the app fails to conform to an applicable warranty, you may notify Apple for a refund of the purchase price (if any). To the maximum extent permitted by law, Apple has no further warranty obligation in respect of the app.
(e) Aussiely, not Apple, is responsible for addressing any claims you or a third party may have relating to the app, including product liability, consumer protection, and intellectual property infringement claims.
(f) Apple and its subsidiaries are third-party beneficiaries of these terms. Upon your acceptance of these terms, Apple has the right to enforce them against you as a third-party beneficiary.
Google Play apps
If you download JoeyDrive from the Google Play Store, the following additional terms apply:
(a) The licence is limited to use on Android devices you own or control, subject to the Google Play Terms of Service.
(b) Aussiely, not Google, is solely responsible for the app and its content.
(c) Google has no obligation to provide maintenance, technical support, or warranty services for the app. Direct all support requests to Aussiely:
(d) Aussiely, not Google, is responsible for addressing any claims you or a third party may have relating to the app, including product liability, consumer protection, and intellectual property infringement claims.
(e) Google is not a party to these terms and has no warranty, support, or liability obligations in respect of the app.
Bookings and cancellations
The app facilitates lesson bookings between learners and instructors. The service is currently provided at no charge. Instructors and learners are responsible for honouring confirmed bookings or providing timely notice of cancellation. Any future pricing or cancellation policies will be communicated in advance and will update these terms.
Engagements
Any project work, prototypes, or software we deliver to clients is governed by a separate written engagement letter or statement of work. Nothing on this website or within the app constitutes a binding offer to provide services beyond the lesson booking platform.
Termination
We reserve the right to suspend or terminate your account or access to the app at any time if you breach these terms or use the service in a way that is unlawful, harmful, or disruptive. You may stop using the app at any time by deleting it from your device.
Disclaimers
Our website and app are provided on an "as is" basis. To the extent permitted by law, we exclude all warranties not expressly set out here. Nothing in these terms limits any rights you have under the Australian Consumer Law that cannot lawfully be excluded.
Liability
To the extent permitted by law, Aussiely's total liability arising from your use of the website or app is limited to AUD $100 or the total amount you have paid us in the 12 months preceding the claim, whichever is greater.
Governing law
These terms are governed by the laws of Australia. Any dispute will be handled by the courts of the state in which Aussiely is registered.
